Under Obamacare “Part-Time” Will be “Full-Time”

The recent 7.8% unemployment figure left people scratching their heads because it seemed manipulated to reflect a smaller and more politically safe number. Then, we found out that it was low not only because the Bureau of Labor Statistics don’t include those who gave up looking for employment, but also because so many people are now considering their part-time jobs their full-time jobs.

There is a little known Obamacare provision that actually redefines the term “full-time.” Currently, the threshold between part-time and full-time is forty hours per week. The new definition lowers the threshold to thirty hours per week. This is bad news especially for small business owners who were hoping to be able to depend on part-time workers to get around Obamacare’s mandates.

Obamacare will require that businesses with at least fifty full-time employees provide health insurance to all workers or face heavy fines. Many businesses were hoping to be able to cut people’s hours or hire part-time workers so that they could avoid the health insurance mandate and/or the noncompliance penalty. Now, they won’t even be able to do that.

All the part-time workers they have will now be considered full-time if they worked an average of thirty hours per week during a previous three-month employment period. Employers can look back three  to twelve months to determine each employee’s average number of hours per week worked. Once an employee is determined to be full-time based on that “look back” period, that employee will maintain that full-time designation for the next six months, regardless of a change in hours during those six months. In other words, according to CNS News:

“[A]n employer calculates the hours an employee works during at least a three-month period, determining if the employee has worked thirty hours or more per week on average. If the employee meets the thirty-hour threshold, they are counted as full-time for at least six months. If the employer has at least fifty such employees, he must provide them with health insurance or pay a fine.”

 How is this supposed to help make sure everyone gets free and adequate healthcare coverage? It will only ensure that many more people sign up for Medicaid and food stamps after their employers are forced to shut down. The Democrats’ solution to a failing economy is letting tax cuts expire, raising taxes and forcing compliance to more bureaucratic and costly regulations. Those measures only serve to hasten a complete economic collapse.

    It might be great to call a 30 hour week “full time” for some but, I don’t think my boss will pay me the same if I only show up for 3/4 of the time. This isn’t Europe and this won’t fly with American employers from EITHER party.

      Since government is one of Americas largest employers, are they going to cut their employees hours? We all know Congress and the Senate are exempt because they only work about 20 hours per MONTH now!!!

    I have read a lot of articals about this some on Yahoo.com you know its bad when Yahoo reports on it. I have talked to civlyan contracters in afganistan who say its going to be cheaper to higher more employees than to comply with Obama care. I gess the new norm is going to be getting 2 25 hour jobs to replace the one job that you would have had before this law.
    The worst part of this law is it just penalizes every one. If a company dose not give its employies enough covrage they get fined. If they provide tomuch they get fined. My brothers imployer told me this just before they fired him for looking at a mexican the wrog way.
    Political correctness has gon way to far. It has gotten to the point whear you can get fired because some one simply acuses you of hurting their feelings. If some one is at the bottom rung of a company who cares what they say. As long as they can do a adiqute job. I can fully undrstand not promoting a raciet but fireing some one thats on the bottom run for it dose not make sence.

          Probably not as I would have a stack of resumes to look through and his would hit the round file as soon as I saw it if it looked like that. If he was more careful with it, then who knows. Doesn’t matter, I’m not in a position to hire anyone. For the record, I make mistakes in these posts also. Sometimes bad spelling gets through even though I proofread before I hit submit. These things happen. I’m much more careful with my resume.

          What he said is sound once you get by the errors.

          By the way, I noticed you left the question mark off of your question. :-) I know, I’ve done that one myself.

    This is so true. And at first it may only apply to the companies with 50 or more employees, but you can bet eventually they will get to the employers that have 25, then 10 and we will all be out of business! We have under 20 employees right now, yet our insurance company requires to see our tax returns in order to sign up and our L & I reports. They also require us to fill out a report every year, and can ask to see our quarterly reports at any time, and are keeping track of that “look back period” and have been for the past 2 years. SO tell me why they are doing this (they said it is FEDERAL regulations that require them to do this), EVEN THOUGH WE HAVE UNDER 20 EMPLOYEES. Don’t believe that Obamacare is going to stop at 50, all small businesses are in danger and if that happens, we are another one that will be closing our doors. We can’t afford to pay $6,000 per year per employee (at current rates, which have risen 30% for the past 3 years) out of our earnings or we will be bankrupt. And another thing to pay attention to- they are going to take a calculation of all of your employees, and add up the part time hours and see how many full time employees that is equivalent to! This is called your FTES. Then they will fine you on how many FTES you don’t have insured! SO if you have two employees, one working 10 hours a week and the other 20, that equals one full time employee, and you are fined for not having insurance on one full time employee! Don’t be fooled by this legislation- it is going to ruin our businesses, including ours! PLEASE VOTE! This Obamacare needs to be repealed- I don’t think they realize the damage it is going to do to our businesses. If they think unemployment is rampant now, what do you think will happen in the future when all of these provisions are in effect?

    Too many government assistance programs and too few paying taxes. The 70’s was the last time the U.S. exported more than it imported. Jobs are leaving America at a rapid rate because of too many governmental regulations and restrictions.

    My son has a small business and I see the government bs he must wade through and hoops he must jump through. It’s a good thing he has an eatable product or he would never be able to feed his family. The handfull of part time workers are a God send for him but not for long if Obama and his health rag has anything to say about it. As long as Obama is at the helm, one or two more years, my son will have to give up his “dream” and go back to banking with his earned college degree. Some how, I feel that if Obama could tax every worker and business 100%, he would do it. You can guess where that leads.

    I wonder if the company has a “contract” if it will supersede this law??? The PO has “Part Time Flex’s” that can not get over 40 hours,,, I wonder if the law over rules the contract of they will ask for a waiver to get around it??? Just making a law like this messes a lot of things up in the details…. also, I have not found that “provide health insurance to all workers or face heavy fines” does not mean “give” or “provide for free”…. you still have to pay for it. May I ask, how “affordable” will it be when you are trying to live and pay bills and you now have a 29 hour week on your check??? There are plenty of choices out there already to pay for. They don’t have it because they can not afford it… they really won’t be able to afford it if their pay is cut to avoid fines for the company trying to stay afloat.

    I wonder how this will affect truck drivers. Many are paid by the mile, not the hour. I suppose they will use the hours driven to force the issue. And what’s to stop employers from reducing everyone’s hours to say, 25 to get around this (where they can). I’m not sure when this monstrosity takes effect in regard to this rule, but employers can start now so the three month look-back is covered. All this will accomplish is that we all become poorer so we have to rely on an ever increasing bureaucratic monster to “take care” of us. We MUST get this communist b-tard out and take the Senate so Obamacare can be repealed.
