California Child Protective Services Faces Audit After Stealing Baby From Parents

In April I reported about Sammy Nikolayev, the five month old son of Alex and Anna Nikolayev.  Sammy is the first child of the young couple and he was born with a heart murmur.  The parents took excellent care of Sammy and kept all of the necessary doctor appointments.

In April, Sammy developed flu-like symptoms so Anna took him to the doctors at Sutter Memorial Hospital where he had been seen regularly.  On previous visits to Sutter, Anna says that some of the care had caused her concerns, such as the time a nurse came in and gave Sammy some antibiotics.  When she asked the nurse what they were and what they were for, the nurse had no idea.  Upon the doctor’s return to room, Anna found out from the doctor that Sammy should not have been given the antibiotics.

On the occasion in April, Sammy was admitted to the pediatric ICU because of his flu-like illness so they could monitor his heart.  After a couple of days in the hospital, the doctors told Anna that they needed to do open heart surgery on Sammy right away.  The news didn’t set well with Anna and being the responsible mother she is, she wanted a second opinion from another doctor at another hospital, so she took Sammy to Kaiser Permanente Medical Center to get a second opinion.  While at the hospital, the police showed up and insisted on seeing Anna and Sammy.  They told Anna that they had received a report from Sutter Memorial Hospital that Sammy’s health was in danger.

The doctor who saw Sammy at Kaiser said that he was safe to go home with his parents and that the baby was in no danger.  After talking to Anna, seeing Sammy smiling and reading the doctor’s report, the police were satisfied and left.

The next day, police and Child Protective Services showed up at the Nikolayev house.  They pushed Alex away as they entered the house without permission.  One police officer told Anna that he was taking the baby and not to resist him.  For reasons I’m not sure of, the couple had a hidden video camera recording the incident which caught the officer’s actions and words.

The young parents were frightened and horrified and immediately retained the services of an attorney.  Anna was eventually allowed a one hour supervised visit with Sammy in the hospital.  Alex and Anna said they came to the United States to escape a communist government, but feel that they are being treated the same way here in the US.

Once the news of what happened to the Nikolayev family and little Sammy, the public became outraged and launched a number of protests against the California CPS.  Sammy was also returned to the custody of his parents, possibly due to the public outrage and in response to the legal action taken by his parents.  The outrage was so great that a bipartisan vote of members of the Joint Legislative Audit Committee has initiated a statewide audit of the CPS.

Assemblyman Tim Donnelly (R-Twin Peaks), initiated the move to audit the state’s Child Protective Services.  Speaking at a rally for the Nikolayev family, Donnelly said:

“These agencies answer to us, to we the people, and when your name is Child Protective Services, you should be protecting children.”

Assemblyman Mike Gatto (D-Los Angeles) also expressed his concern about how things like this could happen:

“The question is: How did this happen, why did this happen, and what can we do to make sure that it never happens again.”

I know that Child Protective Services is supposed to watch out for the safety and welfare of all children and that for the most part they do a good job.  However, we’ve all heard of too many instances where they have gone beyond their prescribed duties and have caused more harm than good to many families.

I worked with a gentleman some years ago that had twin sons.  At about 7 months of age, one of them died of what doctors said was sudden infant death syndrome.  He and his wife were devastated by the loss of their son.  Several days later, he was charged by CPS with child cruelty that led to the death of his son.  His other son was removed from the home and placed in foster care.  The stress of the situation and doubts that crept in caused his wife to leave him.  Eight months later, he was exonerated, but the damage was done and the family destroyed.  What once was a very happy and pleasant co-worker was now a bitter and angry single man whose life had been destroyed because of some overzealous CPD worker that didn’t want to accept the doctor and coroner’s cause of death ruling.

I’m glad to see that Sammy Nikolayev was returned to his parents and that California CPS will be audited.  Even though the audit could take six months or more, they know they are under a magnifying glass which should be enough to prevent them from repeating their abuse with another family.  Hopefully, the audit will bring about necessary changes and save other family from going through what the Nikolayev family and my former co-worker have gone through.

    The question is not “how do we prevent this in the future”, the real question is exactly how many CPS workers are going to prison for kidnapping a baby, and for gross violations of the family’s rights.

    I don’t know if these CPS people are NAZIS or Fascists, or both, but the all need to be fired, put on trial, and thrown in prison for at least 25 years.

    The problem is that these people are little small minded leftist Fascists, who have far too much power. They need to be taught a lesson on exactly who they work for.

      And after they get out they need to be permanently banned from any and all positions that involve working with kids in any way,shape form or fashion! And the cops who were involved in this fiasco need to be fired as of RIGHT NOW and permanently banned from any position in law enforcement as well.

      I hear and second the notion lol, I started my own country and I call it Liberty, its eaxtly the size of my butt when I’m sitting, and my feet when I’m standing etc. They can never take it from me, it moves when I do :) As for the atheism, have you seen “ultimate proof of creation” on youtube?         As you can see from my tag, I go by the Atheist Libertarian… not the Libertarian Atheist. in this context, the term “Atheist” serves to describe the noun… “Libertarian”. the point of including the term atheist in my tag, is mostly to indicate that I have no interest in debating religious view points.

        I respect yours.. and will defend them to the last… but my interest is in libertarian ideals. (which allow for any religious views you may have)… as long as your views don’t effect others…. Not in religion.

        When you call yourself a conservative or libertarian, the leftist fascists try to put you in the “Religious whacko” box. My tag lets them know that they are barking up the wrong “constitution toting dangerously over educated libertarian” tree by doing that.

        The sad thing is these people absolutely believe they are in the right. It becomes a personal campaign to “right the evils of the world” highhandedly. They increase their deviance incrementally and eventually do these atrocities as a course of normalcy in their lives. They seldom see how far they over-reach. The mind set that EVERY child is better in the Social institution seeps in, and they have the power to force it. Once they step into your life, you are threatened, and forced to comply. AND they have the power to throw the book at you by referring EVERY enforcement agency to join their game. They will be followed up by Police, Code enforcement, the housing inspectors, and every little tin-pot dictator in the social reform network. ALL based on anonymous accusations form people you are not allowed to identify.

    A similar kidnapping happened last yr. at Hershey Medical Center to a couple who had just had a baby that day. The mother was evicted from the hosp. after wanting to wait on a vitamin shot until the husband returned from an errand. All facts came out where multiple fascist type acts were made against them before taking the baby, AND soc. srcs. and the hosp. apologized (knew they were in the wrong, are getting sued now).

    Don’t just jail the individuals…investigate why there’s a gov. culture of taking rights away from parents. Where are checks and balances of a 2nd opinion when a gov. action so severe as taking a child comes up? Maybe a 2nd set of eyes on the case will prevent these situations. It goes beyond a few rogue agents. (sound familiar? IRS excuse)

    All government agencies should accept they are always UNDER THE MICROSCOPE….but they do not. Liberals over reach…it’s consistent and it’s inevitable…so the bigger question is WHY DO WE CONTINUE TO GIVE POWER TO LIBERALS. The all believe THEY ARE THE ONLY ONES CAPABLE OF GETTING ANYTHING RIGHT and they prove time and again THEY ARE WRONG.

    Every state has workers in CPS who do the same things. They are given limited power, and then, on their own, decide to expand that authority/power. A couple my wife worked with had a run-in with TXCPS a few years back. This was caused by a third party family (actually, the daughter), which brought in CPS. A caseworker came out to “examine” the home atmosphere. The couple (at that time) had a 3-y/o boy. The caseworker found that the toilet seats were not lockable, and said they would be taking the boy. This caseworker was pregnant, and when asked by the couple if her toilets were going to be lockable, she replied it was none of their business. She was the one investigating. The caseworker was turned in, and was eventually fired for requiring something that she herself didn’t furnish.

    This has been going on for years. I worked with the Federal Government that monitored child protective services in most of the counties in our 8-state region. I read hundreds, if not thousands of child welfare records to see how social workers were handling cases. I was appalled at some of the things social workers were doing. They have unlimited power and you will end up in court if you challenge them.

    CPS should be audited for the financial incentives they, the courts, and law enforcement receive for taking a child into “protective services” and “foster care”. Children are at more risk for abuse and neglect in foster care than anywhere else.

      An open case brings in money to the agency. Every case is kept open for 12 months even when it is determined there is no cause of continued action. How much money per case is determined by the number of people in the family, the cause for the investigation and other variables. An open case for a family of 4, 12 months can get H&W over $100,000. AND they do not have to account for how the money is spent.

    Power corrupts – absolute power corrupts absolutely. No one can handle power correctly, that is why there are or should be term limits to EVERYTHING. CPS just got too powerful for itself and became an oppression machine. That’s what happens to all government agencies.

    Oh heavens no, an audit!! What can be worse than an audit? After 6 – 12 months when the audit is complete and everyone has forgotten about the incident, the audit will reveal that Child protective services was operating under departmental guidelines and policies. And it will be swept under the rug just as so many murders and other crimes committed by cops. This is how a police state works and we can’t stop it. All people at the top of these thuggish agencies are APPOINTED and the people that appointed them never take responsibility – EVER. That’s how you protect those sources of power. And Americans gnash their teeth, wring their hands and watch as their freedom and liberties are completely stripped away.
